This webinar brings together an experienced panel of mediators, attorneys and a federal judge to examine current strategies for resolving complex class actions. Moderated by mediator Lance August Harke, the panel features The Hon. David R. Proctor, plaintiff attorney David L. Selby II, defense attorney Frank A. Zacherl and mediator Rodney A. Max. Panelists will address emerging trends in class action filings, increasing case complexity and heightened judicial scrutiny of settlements and fee requests.

The program will provide practical guidance on building effective “settlement relationships,” utilizing advanced mediation techniques, structuring settlement agreements and navigating key issues such as injunctive relief, objector challenges, and attorneys’ fees. Ethical considerations in class action negotiations and strategies for obtaining judicial approval will also be discussed, offering attendees actionable insights for successfully managing and resolving class action disputes in today’s litigation environment.

Rodney A. Max

Among more than 8,000 mediations Rodney Max has led are federal and state class and mass actions in consumer products, services and statutory remedies spanning insurance, pharmaceuticals, transportation, and environmental, computer, cellphone, and other technological issues (TCPA, FCRA, DPPA).

R. David Proctor

Dave has been a U.S. District Court Judge for the Northern District of Alabama since 2003. While in private practice, prior to his judicial career, his clients included Xerox Corp., O’Neal Steel, The Children’s Hospital of Alabama, Helen Keller Hospital, Norwood Clinic, North American Bus Industries, Inc., and Southeast Alabama Medical Center

David L. Selby II

David is the Practice Group Leader of Bailey Glasser’s nationally ranked Mass Torts Practice Group and has extensive experience in nationwide class actions and MDL proceedings. He has served as a leader in major product liability and mass tort litigations, and led the plaintiffs’ team in a landmark $239 million class action.

Frank A. Zacherl

Frank is a partner with Shutts & Bowen LLP and leader of the firm’s Class Action team. An AV-rated trial lawyer, he focuses on complex civil litigation, class action defense, and high-stakes commercial disputes, and has handled national and statewide class actions in state and federal courts throughout Florida.

Lance A. Harke

Before becoming a full-time neutral, Lance Harke practiced in the area of multi-state consumer class action litigation. He has served as lead class counsel or a member of the plaintiffs’ steering committee in a wide variety of national multi-district mass tort and class action litigations, including some of the largest cases in U.S. history.
