I have blogged ad nauseam of the importance of preparing for mediation, preparing your client for mediation, giving an impressive opening presentation, and the like. Well, part of that very necessary and grueling effort should be a decision tree analysis. Decision trees should not just be used for your complex cases – even in the most straight-forward cases they are a tool which litigators and their clients should use to make educated decisions.
