Ed Timberlake recently discussed in the Orlando Sentinel Amendment 4 which will be put to the voters in November 2010. See: http://www.orlandosentinel.com/news/opinion/orl-edpmyword-hometown-democracy-06062409jun24,0,3434376.storyThe proposed Amendment to Florida’s Constitution would require that all technical land-use changes across the state of Florida be put to the voters. Some local governments have enacted their own local versions of this amendment and have been surprised by the consequences.
Timberlake raises the question of whether Amendment 4 is truly a growth-management proposal or whether it is merely a tool with which growth can be halted with “non-stop political campaigning.”
It will be interesting to see how this turns out at the polls… You can bet that the Governmental Affairs Practice Group at the Upchurch Watson White and Max Mediation Group will be watching.
