Our panel of practitioners, mediators and a nationally recognized judge will take you down the path from inception to settlement of class and mass actions along with important practice tips and legislative and legal updates. Unlike private settlements, class action settlements must win the approval of the presiding judge, often following input from objectors. To maximize the chances of passing judicial muster, the relief and fees afforded by the proposed settlement must both be fair and comport with governing case law. This seminar reviews best practices, techniques, and some cutting-edge legal issues, to help opposing counsel reach the one goal they have in common: a mediated settlement that survives judicial scrutiny.

Attendees will be eligible for complimentary continuing legal education credit through eight state bar associations. Accreditation is pending in California, Georgia, Illinois, New Jersey and Texas. Alabama (1.0 total CLE credits) and Florida (1.0 hours of general CLE, plus 1.0 certification credits in Civil Trial) have accredited the program. New York attorneys can claim CLE credit through reciprocity with Florida.

Pam Perry, a highly respected professional neutral, is a great believer in the power of persistence, preparation and creativity in approaching apparently insoluble problems. She is a panel member of the American Arbitration Association, a Florida Supreme Court Qualified Arbitrator and a certified mediator (since 2004).

Judge Lisa Walsh

Lisa Walsh presides in the Complex Business Division of Florida's 11th Judicial Circuit, is the Administrative Judge of the Appellate Division and is an International Arbitration judge in the Civil Division. She has tried over 100 jury trials, authored numerous appellate opinions and was president of the National Association of Women Judges.

Edward H. Zebersky

Ed Zebersky is a founding partner of Zebersky Payne Shaw Lewenz, LLP, and has a practice ranging from traditional personal injury cases to complex litigation. He has prevailed against some of the world’s largest corporations, resulting in settlements and verdicts totaling nearly $350 million.

Paul G. Karlsgodt

Paul Karlsgodt serves as the leader of BakerHostetler’s Privacy and Digital Risk Class Action and Litigation team. He is a thought leader in class action defense with more than 20 years of experience defending hundreds of consumer class actions, mostly in the complex and cutting-edge area of data privacy.

Rodney A. Max

Among more than 6,500 mediations Rodney Max has led are federal and state class and mass actions in consumer products, services and statutory remedies. They concerned insurance, pharmaceuticals, transportation, and environmental, computer, cellphone, and other technological issues (TCPA, FCRA, DPPA). 

Lance A. Harke

Before becoming a full-time neutral, Lance Harke practiced in the area of multi-state consumer class action litigation. He has served as lead class counsel or a member of the plaintiffs’ steering committee in a wide variety of national multi-district mass tort and class action litigations, including some of the largest cases in U.S. history.
