Risk in negotiation can be measured and controlled. Historically, this was not thought to be possible. The future was perceived as a matter of luck, providence or random variation. The thought of controlling risk was outside the ancients’ cultural and philosophical reality.

Howard R. Marsee: Howard was a board-certified civil trial lawyer for 20 years, until 2003. Since 1996, he has served thousands of hours as a mediator, arbitrator and special master. He is certified by the Florida Supreme Court to receive circuit-civil mediation appointments. Howard is also certified by the U.S. District Court for the Middle District of Florida to receive mediation appointments in cases pending before that court, and he is approved by the Florida 5th District Court of Appeal as an appellate mediator. He is a former member of the Florida Bar’s Standing Committee on Professionalism and a current member of the National Academy of Distinguished Neutrals.
