John Fleming Kelly, a mediator and arbitrator affiliated with Upchurch Watson White & Max Mediation Group, recently addressed the Commercial Section of The Association for Conflict Resolution (ACR) during the Section's quarterly teleconference. The title of Mr. Kelly's presentation was "Arbitration, Creature of Contract: The Devil Is In the Details."
Mr. Kelly, an experienced arbitrator and mediator, presented a consideration of the provisions advisable to include in an agreement to arbitrate, whether the agreement is pre-dispute or post-dispute, and the questions left unanswered if not included. Former Director of Dispute Resolution Services for CPR, Mr. Kelly has had the opportunity to review the ADR provisions of a large number of arbitration agreements and to consider whether those agreements addressed the issues presented in planning the arbitration process.
Located in Fort Lauderdale, FL, Mr. Kelly is available to serve as arbitrator or mediator of business disputes throughout the state.
