UWWM Mortgage Foreclosure Mediation Programs

  • Statewide Voluntary Mortgage Foreclosure Mediation Program (for ALL foreclosures not governed by a local administrative order)

RMFMP

On December 20, 2011, the chief judge of the 7th Judicial Circuit entered an order ending the mandatory referral of residential homestead mortgage foreclosure cases to mediation through the RMFMP.  For residential homestead mortgage foreclosure cases filed with the court between July 19, 2010 and December 20, 2011, the order still requires lenders to upload Form A to the 7th Circuit RMFMP.com site and send hard copies of those Form A’s with checks for $400 to Upchurch Watson White and Max.  There will be no change in the manner in which these cases are processed through the 7th Circuit RMFMP system.

Statewide Voluntary Mortgage Foreclosure Mediation Program

Upchurch Watson White and Max Mediation Group is excited to introduce to you its private statewide managed mediation program for ALL foreclosures, a program that builds upon the strengths of the RMFMP but recognizes and improves upon those systematic flaws that kept the RMFMP from becoming the statewide success it was anticipated to be.  The Upchurch Watson White and Max Statewide Voluntary Foreclosure Mediation Program (“UWWM Program”) which went into effect on December 21, 2011 (Click here for a Summary of the Program and the Guidelines for the Program) encompasses what we believe are the “best practices” for foreclosure mediation.

We encourage lenders to participate in the program and we encourage borrowers to request that their foreclosure be referred to it via a Request to Participate.  It will look and feel similar to the RMFMP but it will be more streamlined and efficient.  Of note is that we have reduced our program to a 90 day offering so that the entire process will begin and end within 90 days, 30 days shorter than the traditional RMFMP offering.  Of note also is that we are going to be particularly selective in choosing the mediators that will offer services through the program so that EVERY foreclosure mediator in our Statewide Voluntary Foreclosure Mediation Program is an attorney AND an experienced, full-time Florida Supreme Court certified circuit-civil mediator who is specially trained in foreclosure mediation.
